Terms & Conditions

Effective August 15, 2026

Welcome to davotequila.com. This site is operated by Asuncion Spirits, LLC (“Asuncion Spirits,” “we,” “us,” or “our”), the maker of Davo Tequila, based in Santa Barbara, California.

These Terms & Conditions (the “Terms”) govern your use of davotequila.com and any content, features, or forms on it (together, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree with them, please do not use the Site.

1. You must be 21 or older

This Site is intended only for people who are of legal drinking age in the United States, which is 21. By entering and using the Site, you confirm that you are 21 or older. Misrepresenting your age to enter the Site is a violation of these Terms.

Please do not share this Site, our emails, or our content with anyone under 21.

2. Drink responsibly

Davo is made to be sipped and shared in good company. We ask everyone who enjoys it to do so responsibly and lawfully. Never drink and drive, and never provide alcohol to anyone under 21. If you or someone you know needs help with alcohol use, resources are available at Responsibility.org.

Nothing on this Site is medical or health advice, and nothing on it should be read as a claim that drinking alcohol carries health benefits.

3. Buying Davo through this Site

Asuncion Spirits is a supplier of distilled spirits. It does not itself sell alcoholic beverages to consumers, and it has no ownership, control, or financial interest in any retailer. The store on this Site is an embedded storefront operated by our e-commerce partner, AccelPay. When you place an order, you are buying from an independent, licensed alcohol retailer in AccelPay’s network rather than from Asuncion Spirits. The retailer that accepts your order is the seller of record: it processes your payment, verifies your age, and ships or delivers the product under its own licenses and its own terms of sale. An order is not accepted until the fulfilling retailer accepts it, and the retailer may decline an order as its own terms provide.

Because of that, a few things about buying deserve plain words:

  • Availability. Alcohol shipping laws differ by state. Where Davo can be sold and delivered is determined at checkout by the retailers in the network and the laws of your location. If checkout does not offer delivery to your address, that is the law or the network’s coverage, and we cannot override it.
  • Age verification. You must be 21 or older to place an order. Retailers verify age at purchase, and an adult signature (21+, with valid ID) is required at delivery. Packages will not be left without one.
  • Payment, shipping, returns, and cancellations are handled by the fulfilling retailer and by AccelPay under their own terms and policies, which are presented in the checkout. Questions about an order you placed are best directed through the checkout’s order-support channel; you can also write to us at info@asuncionspirits.com and we will help you find the right door.
  • No resale. Products bought through the Site are for personal enjoyment and may not be resold.

We do not guarantee that any product will be in stock, at any particular price, or available in any particular place. Prices and availability in the storefront can change without notice.

4. Our content and trademarks

Everything on this Site, including the text, photography, video, artwork, logos, and design, belongs to Asuncion Spirits or is used with permission, and it is protected by copyright, trademark, and other intellectual-property laws.

DAVO™, the Davo dove design, and We Drink to Remember™ are trademarks of Asuncion Spirits, LLC.

You are welcome to browse the Site, and to view, download, or print pages for your own personal, non-commercial use. Anything more than that, such as republishing our content, using our photography, or using our name or marks in a way that suggests a connection with us, requires our written permission first. Write to info@asuncionspirits.com; we read what comes in.

If you believe something on this Site infringes your copyright, write to the same address with the details and we will look into it promptly.

5. Using the Site fairly

You agree not to:

  • use the Site in any way that violates a law or regulation, including laws about the purchase, sale, or marketing of alcohol;
  • misrepresent your age or identity;
  • scrape, harvest, or collect information from the Site by automated means;
  • interfere with the Site’s operation or security, or try to gain access to any part of it that is not public;
  • frame or mirror the Site, or use our marks in metadata or hidden text.

We may suspend or block access to the Site for anyone who violates these Terms.

6. What you send us

If you write to us through the contact form or by email, you are responsible for what you send, and you agree it will not be unlawful, abusive, or infringe anyone else’s rights. Ideas, suggestions, and feedback you choose to send us are received as non-confidential, and we may use them without obligation to you. Personal information you include is handled as described in our Privacy Policy.

7. Email and text updates

If you subscribe to our newsletter, we will send you email about Davo: launches, stories, recipes, and events. Every email includes an unsubscribe link, and unsubscribing is immediate and free.

If we offer text-message (SMS) updates and you opt in, message frequency will vary, and message and data rates may apply depending on your carrier. You can text STOP at any time to stop receiving messages and HELP for help. Consent to receive marketing texts is never a condition of buying anything.

8. Third-party sites and services

The Site links out to third parties (retailers, social platforms, press, and resources like Responsibility.org) and embeds services operated by third parties, including the AccelPay storefront. Those sites and services have their own terms and their own privacy practices, which we do not control and are not responsible for. A link from us is not an endorsement of everything found on the other end.

9. What we promise about the Site, and what we do not

We work to keep the Site accurate, current, and available, and we correct what we find wrong. That said, the Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or free of harmful components, or that any content is complete or current at the moment you read it.

10. Limits on our liability

To the fullest extent permitted by law, Asuncion Spirits and its members, managers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, and our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Purchases are made from the fulfilling retailer, and claims relating to an order lie against the seller of record under its terms of sale.

Some states do not allow certain warranty exclusions or limits on liability. If those laws apply to you, some of the limits above may not, and our liability is limited to the smallest extent the law allows.

11. Your responsibility to us

You agree to indemnify and hold Asuncion Spirits harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

12. Governing law and where disputes go

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Santa Barbara County, California, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect.

13. Changes to these Terms

We may update these Terms from time to time, for example when the Site adds a feature or the law changes. The effective date at the top always tells you when they were last revised, and material changes will be reflected there before they take effect. Using the Site after a change means you accept the updated Terms.

14. The whole agreement, and how to reach us

These Terms and the Privacy Policy are the entire agreement between you and Asuncion Spirits about the Site. If we do not enforce a provision, that is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business.

Questions about these Terms are welcome at info@asuncionspirits.com.
