Privacy Policy

Davo Tequila is made by Asuncion Spirits, LLC (“Asuncion Spirits,” “we,” “us,” or “our”), based in Santa Barbara, California. This policy explains what personal information we collect through davotequila.com (the “Site”), why we collect it, who it is shared with, and the choices you have about it.
The short version: we collect what you type into our forms, and standard analytics about how the Site is used. We use it to send the updates you asked for, to answer you when you write, and to understand and improve the Site. We do not sell personal information for money, and every choice we offer you is real and honored.
This Site is intended for adults 21 and older.
What we collect
What you give us.
- Newsletter signup: your email address, and your confirmation that you are 21 or older.
- Contact and press forms: your name, email address, and whatever you write in your message.
- Correspondence: if you email us, we keep the exchange so we can help you and remember what was said.
The age screen. To enter the Site you confirm that you are 21 or older. We do not ask for your date of birth or any other details. The Site keeps only a small flag, for up to 30 days, recording that you confirmed, so the screen does not reappear on every visit.
What is collected automatically. When you browse the Site, we and the service providers named below receive standard technical information: your IP address, approximate region, browser and device type, the pages you visit, how you arrived, and how you interact with pages. Some of this is collected through cookies and similar technologies, described in the next section.
Orders placed through the embedded store. The store on this Site is operated by our e-commerce partner, AccelPay, and orders are sold and fulfilled by independent licensed retailers in its network. When you buy, your checkout information (name, address, date of birth, payment details) is collected by AccelPay and the fulfilling retailer under their own privacy policies. We do not receive your payment card details. We do receive information about orders, such as what was ordered, order value, and contact details, which we use for order support, analytics, and marketing as described below.
We do not ask for, and you should not send us, sensitive personal information such as government ID numbers or health information.
Cookies and similar technologies
The Site uses a small set of cookies and similar technologies, in two groups:
- Essential. These make the Site work: the flag that remembers you passed the age screen, your cookie choices, and basic security set by our host. The Site does not function properly without them.
- Analytics. We use Google Analytics 4 to understand how the Site is used, in aggregate; Google explains its own handling of this data at How Google uses information from sites that use its services. We also use Microsoft Clarity, which records how visitors interact with pages (clicks, scrolling, and movement) as session replays; text you type into form fields is masked and is not captured.
These providers may collect information about your online activities over time and across different websites when you use the Site. Details on each cookie, what it does, and how long it lasts live in our Cookie Policy.
Your controls: your browser can block or delete cookies, though the Site’s essential features may degrade; where the Site shows a cookie-preferences banner, you can review and change your choices there at any time; Google offers an opt-out browser add-on for Analytics; and we honor the Global Privacy Control signal, described under Do Not Sell or Share below. We do not respond to legacy browser “Do Not Track” signals, for which no common standard was ever adopted; the Global Privacy Control is the signal we act on.
How we use information
- To send you the newsletter and other updates you signed up for. Every email includes an unsubscribe link, and unsubscribing is immediate.
- To answer your messages and provide order support.
- To run, secure, and improve the Site, and to understand which pages and stories matter to visitors.
- To respect the 21+ line: your age confirmation exists so the Site is shown only to adults.
- To comply with law, and to establish or defend legal claims if we ever have to.
If we offer text-message (SMS) updates and you opt in, we will use your phone number to send them. Message frequency varies, message and data rates may apply, you can text STOP to end them at any time, and consent is never a condition of buying anything.
Who we share information with
We do not sell personal information for money. We share it in a small number of situations:
- Service providers who work for us, under contracts that limit what they may do with it: Klaviyo (email and, if offered, SMS), Google (analytics), Microsoft (Clarity analytics), SiteGround (website hosting), and AccelPay (the embedded store).
- The retailers who sell to you. When you order, the fulfilling retailer receives your order information directly as the seller of record.
- Lawyers, authorities, and successors when the law requires it, when it is necessary to protect rights and safety, or if our business is ever sold or reorganized, in which case this policy travels with the data.
We never share your information with third parties for their own unrelated direct marketing.
Do Not Sell or Share My Personal Information
California law gives residents the right to opt out of the “sale” of personal information and of “sharing” it for cross-context behavioral advertising. We do not sell personal information for money, and we do not currently use the kind of cross-context advertising tools that California law calls “sharing.” If that ever changes, this policy will say so here first, and these opt-outs will already be honored:
- Use the Global Privacy Control. Turn on GPC in your browser or install a GPC-enabled extension, and the Site will treat your visit as an opt-out automatically.
- Ask us. Email info@asuncionspirits.com with “Do not sell or share” in the subject line, from the email address you want opted out. We will confirm when it is done.
Opting out does not change essential cookies or the analytics that run in aggregate, and it never affects the price or availability of anything.
Your privacy rights
We make these commitments to everyone who uses the Site, whether or not a particular privacy statute applies to us or to you. Wherever you live, we honor these requests about the personal information we hold:
- Access: ask what we have about you, and receive a copy.
- Deletion: ask us to delete it. We will, unless a legal obligation requires keeping a record.
- Correction: ask us to fix something inaccurate.
- Opt out of marketing: unsubscribe from email in one click, reply STOP to any text, or ask us directly.
- Opt out of sale or sharing: as described in the section above.
To make a request, email info@asuncionspirits.com or use the contact form. We will need enough information to verify the request is yours, usually confirmation from the email address on file, and we respond within 45 days. You may use an authorized agent, and we will never treat you differently for exercising a privacy right.
These rights line up with what California law provides its residents, and we extend the same treatment to visitors from every state. California’s “Shine the Light” law also lets residents ask about disclosures to third parties for those parties’ direct marketing; as stated above, we do not make such disclosures.
Visitors under 21
This Site is not directed to anyone under 21, and we do not knowingly collect personal information from anyone under 21, and in no event from children under 13. If you believe someone under 21 has given us personal information, tell us at info@asuncionspirits.com and we will delete it.
How long we keep information
Newsletter information is kept until you unsubscribe or ask us to delete it. Form submissions and correspondence are kept as long as they are useful for answering you and keeping our records straight, then deleted. Analytics data is retained on the schedules of the providers above, in aggregate form.
How we protect information
We use reasonable technical and organizational safeguards: encrypted connections (HTTPS) across the Site, access limited to the people who need it, and reputable providers with their own security programs. No website can promise perfect security, and we will be straight with you if something ever goes wrong.
Where information is processed
The Site is operated from the United States, and information is processed and stored there. The Site is intended for U.S. visitors.
Changes to this policy
When our practices change, this page changes, and the effective date at the top moves with it. If a change is material, we will say so plainly here, and where it makes sense, tell newsletter subscribers directly. Earlier versions are available on request.
